Terms of Service

These terms are the agreement between you and Reclaim Mobility when you use this site. We have tried to write them in plain language. If something here is unclear, email us at reclaimmobility@gmail.com and we will explain it.

1. What this site is

Reclaim Mobility is a marketplace where people in Brandon, Manitoba and the surrounding area list used mobility and homecare equipment for sale, and other people find and buy it.

We are not the seller. We do not own, inspect, test, service, refurbish or certify any item listed here. Every item is owned and described by the individual selling it. Reviewing a listing before it appears is a check for obvious problems and nothing more — it is not an inspection, an endorsement, or a statement that the equipment is safe or fit for anyone in particular.

2. Who may use it

You must be at least 18 years old and able to enter a binding contract. You must give accurate information about yourself and about anything you list. One account per person.

3. Used medical equipment — read this part

Mobility and homecare equipment can fail, and failure can cause serious injury. Brakes wear. Batteries degrade. Frames crack. Weight ratings matter and are not always marked.

Buyers: inspect anything in person before you pay. Check weight capacity, brakes, battery age and condition, and anything structural. Ask when it was last serviced. If an item is prescribed, sized or fitted to a person — a wheelchair cushion, a custom seating system — have a qualified professional confirm it suits you before you rely on it. Nothing on this site is medical advice, and we are not qualified to give any.

Sellers: describe the item honestly, including faults, wear, missing parts and anything you have had repaired. Do not list anything you know to be unsafe, and do not list anything that has been recalled. If an item requires a prescription or professional fitting to be used safely, say so in the listing.

You accept the risk of what you buy and sell here. Any deal is between the buyer and the seller. Selling used medical devices may carry legal obligations under Canadian law depending on the item and how often you sell — that is your responsibility to understand, not ours to police.

4. Listings and moderation

Every listing is reviewed by us before it appears publicly, and we may reject or remove any listing, at any time, for any reason we think is sound — including poor photos, an unclear description, a suspected scam, a prohibited item, or a price that looks like a mistake. If we reject a listing we will tell you why.

Do not list:

  • anything you do not own or are not entitled to sell
  • recalled equipment, or equipment you know to be unsafe or broken beyond the description
  • prescription medication, controlled substances, or single-use sterile supplies that have been opened
  • counterfeit goods or anything that infringes someone else's rights
  • services, wanted ads, or anything that is not a physical item you have

Editing a listing that is already live sends it back for review. That is deliberate, not a fault.

5. Messages, and the fact that we can read them

Buyers and sellers talk through the messaging built into this site. Those messages are stored on our systems and may be read by Reclaim Mobility staff for safety, moderation, fraud prevention, and to resolve disputes. Messages are also scanned automatically for terms associated with scams and with arranging deals off the site.

Every time a member of our staff opens a conversation, that access is recorded. If you want to know whether your conversation has been read and by whom, email us and ask.

Do not send banking details, government identification numbers, or passwords through messages. Do not use messaging to harass, threaten, or send unsolicited advertising.

6. Payments, escrow and fees

Some sales are paid for through this site rather than in cash. Where that applies:

  • Payments are processed by a third-party payment provider. We do not store your full card or bank details.
  • The buyer's payment is held rather than passed straight to the seller, and is released to the seller after the buyer confirms they have received the item, or after a set period following confirmed pickup or delivery.
  • We charge a fee on sales paid for through the site. The fee is shown before you commit to a transaction. We may change fees, and will give notice before a change takes effect.
  • Sellers must complete the payment provider's identity checks before receiving money. That is the provider's requirement and we cannot waive it.
  • If a buyer and seller cannot agree, we may decide how held funds are released. We will look at the listing, the messages and anything either side sends us. Our decision about held funds is final as far as this site is concerned, and does not stop either of you pursuing the matter elsewhere.

Arranging payment outside the site to avoid fees is a breach of these terms, and it also removes every protection escrow gives you. If a deal goes wrong off-site, we cannot help.

7. Cancellations and refunds

Used equipment is sold as-is by private individuals. There is no general right of return. Where a payment is still held by us, we may refund a buyer if the item was not delivered, or was materially different from its description — a fault the seller failed to disclose, the wrong model, or the wrong item entirely. Buyer's remorse, a bad fit, or a fault that was disclosed in the listing are not grounds for a refund.

Once funds have been released to the seller, any dispute is between the buyer and seller.

8. Suspension and banning

We may suspend or ban an account at any time if we believe someone has broken these terms, behaved dishonestly, put another user at risk, or is arranging transactions in a way designed to avoid our fees or our safeguards.

A banned account can still sign in and read its existing messages, but cannot list items, start conversations or send messages, and its live listings are removed from the site. If you think a ban is a mistake, email reclaimmobility@gmail.com.

9. Your content

You keep ownership of the photos and text you upload. By posting them you give us permission to display, store, resize and distribute them for the purpose of running and promoting the site. Do not upload photos you did not take or do not have permission to use, and avoid capturing other people, addresses or documents in the background of a listing photo.

10. What we do not promise

The site is provided as-is. We do not promise it will always be available, error-free, or that any listing is accurate, that any seller will complete a sale, or that any item is safe or suitable for you.

To the fullest extent the law allows, Reclaim Mobility is not liable for injury, loss or damage arising from equipment bought or sold through this site, from any dealing between users, or from the site being unavailable. Where liability cannot be excluded, it is limited to the fees you paid us in the twelve months before the claim, or CAD $100, whichever is greater. Nothing here limits liability that cannot lawfully be limited.

You agree to cover our reasonable costs if a claim is brought against us because of something you listed, sold, bought, or wrote here.

11. Changes and governing law

We may update these terms. If a change is significant we will say so on the site before it takes effect, and continuing to use the site after that means you accept it.

These terms are governed by the laws of Manitoba, Canada, and the courts of Manitoba, Canada have jurisdiction over any dispute.
